Rosemeier-Roberts Properties Sold to CVS for $1.5M

LOCK HAVEN — The several year effort to complete the sale of two large plots along Bellefonte Avenue in Lock Haven has concluded.

Therecord-online has learned that the selling of the Rosemeier holdings at 311-15 Bellefonte Avenue and the Roberts holdings at 309 Bellefonte Avenue was finalized in early March and the transfer of deeds recorded at the Clinton County Courthouse on Monday of this week. According to transfer information, Pennsylvania CVS Pharmacy, LLC paid $600,000 to Jason Roberts and $900,000 to Robert and Lorrieanne Rosemier, a total sale price of $1.5 million.

CVS through a Camp Hill developer had gone into court over the winter, claiming that Rosemeier and his power of attorney Stephen Poorman had failed to honor a signed sales agreement dating to 2013. The court had directed that a closing for the long-delayed sale be held, a directive that Poorman had unsuccessfully appealed in March.

The final sale price of $900,000 for the Rosemeiers represents a victory for CVS. According to information from the findings of Judge Michael Salisbury, project developer J.C. Bar Development had in November of 2013 entered into a sales agreement for three Rosemeier parcels along Bellefonte Avenue and Commerce Street. That agreement had called for a $900,000 purchase price. As noted in Salisbury’s February court opinion, Rosemeier subsequently appointed local businessman Poorman as his “true and lawful attorney, including authority to act on his behalf with respect to the property.”

On Nov. 30 of 2014 Poorman sent a letter to J.C. Bar “demanding to increase the purchase price” to $1.1 million. In December of 2014 Bar rejected that offer. According to the court opinion, the developer contends that Rosemeier breached the agreement in bad faith in attempting to increase the sales price by $200,000.

The sale was subsequently finalized early last month; it was done through the internet, there was no face-to-face closing.

Attorney Lee Roberts, who had represented his son in the extended process, said today, “In spite of all the efforts of Steve Poorman to keep CVS from coming to Lock Haven, I am pleased we are successful in bringing CVS to town.”

Poorman was not immediately available for comment.

It is understood the developer will begin site preparation as soon as possible.
